1. Scope
1.1. These Terms and Conditions (“Terms”) govern your use of the web application and services provided by TRAVSOL SRL under the brand name “Drumul lui Pintea” (“App”, “Service”).
1.2. By accessing or using the App, you fully accept these Terms. If you do not agree, do not use the Service.
1.3. The Operator reserves the right to modify these Terms at any time. Users will be notified by email or via an in-app announcement. Continued use after modifications constitutes acceptance of the new terms.
2. Service Description
2.1. Drumul lui Pintea is a digital platform for self-guided audio-video tours with GPS-triggered content, offering cultural, historical, and entertainment information about Maramureș and the character Pintea the Brave.
2.2. The Service runs in your mobile device’s web browser and does not require downloading from app stores (App Store, Google Play). Content can be downloaded for offline use.
2.3. Entertainment nature. The audio, video, and text content within the tours is created for entertainment and general tourist information purposes. It includes folk legends, local stories, and artistic interpretations of historical events. The Operator does not guarantee absolute historical accuracy, completeness, or scientific precision of the information presented.
2.4. We are not licensed guides. The Service does not replace the services of a licensed tour guide, museum curator, history professor, or any other qualified professional. The user understands and accepts that the information provided within the tours is for informational and entertainment purposes only.
3. Registration and Account
3.1. To use certain features (purchases, progress saving), the user may create an account by providing their name and email address.
3.2. The user is responsible for maintaining the confidentiality of their login credentials. All activity under the account is the user’s sole responsibility.
3.3. One account per person is permitted. Multiple accounts created by the same person may be deactivated without prior notice.
3.4. Accounts and purchases are personal and non-transferable. They cannot be assigned, sold, transferred, or shared with other individuals.
4. Purchases and Payment
4.1. Tours and bundles may be free or paid. Prices are displayed in Romanian Lei (RON) or Euros (EUR), VAT included.
4.2. Payment is processed through NETOPIA Payments, which accepts credit/debit cards (Visa, Mastercard) with 3D Secure authentication.
4.3. Purchase confirmation is sent to the user’s email address, including the product name, amount paid, date, and validity period.
4.4. Prices may change at any time, but changes do not affect purchases already made.
4.5. Each purchase has a limited validity period, expressed in number of days. The exact period is displayed on the tour or bundle page before purchase. After expiry, access to the content is automatically deactivated.
5. Refunds and Cancellations
5.1. Due to the digital nature of the products (content becomes available immediately after purchase), refunds are not granted after downloading or accessing the purchased content, in accordance with EU Directive 2011/83/EU, Article 16(i), regarding the exception of digital products from the right of withdrawal.
5.2. Exceptions — we offer a refund or alternative solution in the following cases:
– Technical defect attributable to us — if a purchased tour cannot be accessed due to a platform error, we will fix the issue or offer a full refund.
– Payment error — if an amount was incorrectly charged (duplicate, incorrect amount), we refund the difference.
5.3. Refunds are processed within a maximum of 14 working days from approval.
5.4. To request a refund, contact pintea@viteazul.ro with your name, tour name, purchase date, and reason.
6. Assumption of Risk and Personal Safety
6.1. Travel risk. The user assumes full responsibility for their personal safety while following routes recommended in the tours. The Operator is not liable for injuries, losses, property damage, or death occurring during travel on routes, regardless of cause.
6.2. Varied terrain. Routes involve travel on varied terrain — paved roads, footpaths, forest trails, mountain paths — which may present objective and subjective hazards (uneven ground, slippery surfaces, wildlife, adverse weather conditions, etc.). The user is required to:
– wear footwear and clothing appropriate for the terrain and weather conditions
– assess their own physical limits before starting a route
– stay hydrated and protect themselves from sun/inclement weather
– observe road and mountain safety rules
6.3. Access to POI premises. The Operator does not own, manage, or control the tourist attractions, museums, churches, monuments, or other locations featured in the tours (“POIs”). The Operator assumes no liability for:
– injuries occurring inside or on the premises of POIs
– the state of conservation, structural safety, or access conditions of POIs
– visiting hours, entrance fees, or availability of POIs
– temporary or permanent closure of POIs
– conduct of staff at POIs
6.4. Minors. Individuals under 18 may use the Service only under the supervision of a parent or legal guardian, who assumes full responsibility for their safety on the route.
7. Accuracy of Information and Limitation of Liability for Content
7.1. Informational and entertainment content. The information within the tours (texts, audio recordings, images, videos) is created based on historical research, local sources, and Maramureș folklore, but does not guarantee absolute historical, scientific, or factual accuracy. Folk legends and stories may contain fictional, symbolic, or hyperbolic elements characteristic of oral tradition.
7.2. GPS data and maps. Maps and location data within the app are provided for informational purposes and may contain inaccuracies. Factors affecting accuracy include, but are not limited to: weather conditions, changes to road infrastructure, weak or unavailable GPS signal, natural or artificial obstructions. Do not use the App as your sole navigation system in situations requiring absolute precision.
7.3. No professional advice. The content does not constitute legal, medical, financial, historical, or any other professional advice.
7.4. Service availability. The Operator makes reasonable efforts to keep the Service operational but does not guarantee uninterrupted availability, error-free operation, or absolute platform security.
8. Limitation of Liability
8.1. To the maximum extent permitted by applicable law, the Operator and its employees, affiliates, and partners shall not be liable for any loss, damage, injury, cost, or expense, whether direct or indirect, resulting from or in connection with:
– the use or inability to use the Service
– following any route recommended in the tours
– accessing any POI mentioned in the tours
– inaccuracies in the information presented
– delays, data loss, service interruptions
– actions of third parties (including but not limited to POI administrators, authorities, other tourists)
8.2. The Operator’s total liability for any damage resulting from the use of the Service is limited to the price paid for the respective tour. If the user has made no payment, liability is limited to 0 (zero) RON.
9. Intellectual Property Rights
9.1. All content within the App — texts, audio recordings, maps, images, videos, graphics, interface — is the exclusive property of TRAVSOL SRL or its licensors and is protected by Romanian Law No. 8/1996 on copyright and related rights.
9.2. The user receives a personal, non-exclusive, non-transferable license for the duration of the purchase validity period, to use the content exclusively for personal, non-commercial purposes.
9.3. Copying, redistribution, resale, rental, licensing, modification, or commercial use of the content is prohibited without the Operator’s prior written consent.
10. Data Privacy
The processing of personal data is governed by the Privacy Policy available at https://drumulpintea.ro/en/cookie-consent.
11. Force Majeure
The Operator shall not be liable for failure to perform obligations caused by force majeure events as defined by applicable law: fires, earthquakes, floods, epidemics, pandemics, war, acts of terrorism, social disturbances, power or internet outages, strikes, or other events beyond the Operator’s reasonable control.
12. Governing Law and Jurisdiction
12.1. These Terms are governed by Romanian law.
12.2. Any disputes shall first be resolved amicably. If unsuccessful, jurisdiction lies with the courts of Baia Mare, Romania.
12.3. If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.
